White Door Photo Booth Rentals - Terms and Conditions of Service
1. AGREEMENT TO TERMS By renting services from White Door Photo Booth Rentals ("Company"), the client ("Client") agrees to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between Client and Company.
2. SERVICE DESCRIPTION White Door Photo Booth Rentals provides photo booth rental services for events including, but not limited to, weddings, corporate functions, parties, and other private or public gatherings.
3. RESERVATION & PAYMENT A non-refundable deposit is required to secure the date of the event. The remaining balance is due no later than seven (7) days prior to the event. If the full payment is not received, Company reserves the right to cancel the booking.
4. CANCELLATIONS & REFUNDS All deposits are non-refundable. Cancellations made less than fourteen (14) days prior to the event are subject to full payment. Rescheduling may be accommodated subject to availability but is not guaranteed.
5. EQUIPMENT USAGE & DAMAGE Client acknowledges responsibility for the safety and condition of the equipment during the rental period. Any damage, loss, theft, or excessive wear caused by Client, guests, or event staff, including but not limited to intoxicated behavior, negligence, or misuse, will be billed to Client at full repair or replacement cost, including any associated labor and shipping fees.
6. INDEMNIFICATION & LIABILITY WAIVER Client agrees to indemnify, defend, and hold harmless White Door Photo Booth Rentals and its owner(s), employees, or subcontractors from any claims, damages, losses, injuries, or legal actions arising from the use of the photo booth equipment or services, including but not limited to: bodily injury, property damage, lost data, or any consequential damages.
7. MALFUNCTIONS & SERVICE INTERRUPTION While every effort is made to ensure reliable operation, White Door Photo Booth Rentals is not liable for any failure of equipment, power outages, software crashes, or unforeseen circumstances that prevent full operation of the photo booth. In such cases, partial refunds or time extensions may be provided at the sole discretion of the Company.
8. IMAGE STORAGE & LOSS Company will store images from the event temporarily and will provide the Client with a downloadable link or USB (if part of the package). However, Company does not guarantee permanent storage of files. Loss or corruption of images due to software error, hardware failure, or acts of God is not the responsibility of the Company.
9. CONTENT & CONDUCT POLICY Client and guests are expected to behave in a respectful manner. Company reserves the right to cease operation and remove equipment if any behavior endangers the operator, guests, or equipment without issuing a refund.
10. VENUE ACCESS & SETUP Client must ensure that the venue allows reasonable access, electricity within 10 feet, and sufficient space (minimum 8x8 ft). Any delay in setup due to venue constraints may reduce total booth operation time without refund.
11. SOLE PROPRIETOR NOTICE White Door Photo Booth Rentals is operated as a sole proprietorship. All contracts and liabilities are bound to the individual owner. Insurance is maintained, but Client acknowledges that legal liability remains limited to the extent allowable by California state law.
12. GOVERNING LAW These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of California.
13. ENTIRE AGREEMENT This document constitutes the entire agreement between the Client and Company and supersedes all prior oral or written communications.
By booking services with White Door Photo Booth Rentals, Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
White Door Photo Booth Rentals - Media Release Agreement
1. Acknowledgment of Image Capture
By entering and using the White Door Photo Booth ("the Booth"), all participants acknowledge and agree that photos and/or videos may be captured during the course of the event. These media may include individual or group images, and may feature identifying visual characteristics such as clothing, hairstyles, tattoos, or other personal likenesses.
2. Consent to Use
Unless otherwise stated in writing, all individuals photographed or recorded while using the Booth grant White Door Photo Booth Rentals, its agents, employees, contractors, and licensees the unrestricted and irrevocable right to:
Use, reuse, publish, and republish photographs or videos of them
In whole or in part, individually or in conjunction with other images or media
In any medium now known or hereafter developed, including but not limited to:
Websites, print materials, social media, digital advertisements, online galleries, promotional emails, signage, or editorial use
For the purposes of advertising, marketing, promotion, or portfolio display
This consent is granted without compensation, limitation, or time restriction.
3. Ownership
All photographs and video captured by the Booth remain the exclusive property of White Door Photo Booth Rentals. Participants agree that no ownership, copyright, or licensing rights in the captured media shall be transferred to them.
4. Opt-Out Procedure
White Door Photo Booth Rentals respects the right to privacy. If any individual does not wish for their likeness to be used in promotional or marketing materials, they must notify the event host, who will in turn notify White Door Photo Booth Rentals in writing within 72 hours of the event's conclusion.
White Door Photo Booth Rentals will make reasonable efforts to remove and/or avoid using images containing the individual who has opted out, provided that:
The request includes a clear description of the individual’s appearance, and
The image is not already in active print or advertisement circulation
Please note that failure to notify the host or business in writing constitutes implied consent to the terms above.
5. Group Images
White Door Photo Booth Rentals reserves the right to use group images or crowd shots where individual identification is not prominent. These do not qualify for opt-out unless the individual is clearly and dominantly featured.
6. Legal Jurisdiction
This release shall be governed by the laws of the State of California. Any disputes arising out of this agreement shall be resolved in the appropriate courts located within Sonoma County, California.
7. Agreement to Terms
